Foreign Investors And EB5 Visas

Foreign investors have the opportunity to apply for EB5 Visas. Congress approved this specific type of visa in 1990. The Congressional Act remains in effect until September of 2012, but it may be extended. Its purpose is to allow immigrant investors the right to live permanently and lawfully in the United States of America. In exchange for this privilege, investors agree to help create jobs and stimulate economic prosperity in America.

This program is designed to infuse billions of investment dollars into new and existing businesses in the United States. It is a win-win agreement for both the government and investing immigrants. The government gets an infusion of cash to create jobs, and the foreigner secures an opportunity to enjoy the benefits of permanent and legal status in America.

One way for you to invest in America's bottom line is to open a new business on US soil. Your business plan needs to include the hiring of ten or more American workers. In addition, you must agree to be the day-to-day manager of operations in your own establishment.

Another way for EB5 Visa applicants to invest in the American economy is to provide funds for a failing business. The troubled company must have business records for at least two years. This business must also show a net loss of 20 percent or more for the previous 12 to 24 month period.

The first step in the process if for the investor immigrant to file an application called I-526. The form must include all pertinent information and documentation. Once this initial application is approved, the investor files another document that secures a conditional ability to live and work in the United States.

Your conditional period is two years. Once you have fulfilled all of the requirements for the EB5 Visas, you will file Form I-829. After this final request is approved, you and your immediate family members will become official residents and honored participants of the American spirit.
