Services Offered By A Reputable Military Attorney

By Lana Bray

Every kind of professional needs the presence of another expert in their lives. There is some sort of interdependence. This arises from the commonly said statement that even doctors cannot treat themselves. So the army also needs a lawyer. Just like everyone, they need some legal knowledge in their midst to handle anything that originates in the law. This is where a military attorney comes into the picture.

The main responsibility of the lawyer is to offer legal advice. The members of the army interact with citizens all the time. They need to know what they can do, and what they cannot . This covers their behavior outside the barracks. They have rules that regulate their relationships between themselves. These too need to be made clear to them. The rationale and extent of these can be best brought out by an advocate.

When soldiers are on a mission, they are under some law as well. It defines the scope of their mandate. If they act in violation of it, they are liable to punishment. Because of the sensitive nature of their operations, they need to understand it. Human right provisions can be used to bring suits against the army. When this occurs, they must be able to show that they acted under some law. If they can explain why it was necessary to do so, the better.

If a member of the disciplined forces is to face charges in a court martial, they need the counsel. This is a requirement in the constitution. Every person accused of anything must be afforded legal representation. It is needed so that to give one a fair trial. Even the army must not act in violation of the supreme law of the land. If they did, it may be used against them in an appeal. Any person engaged in this capacity must fully understand the laws applying.

Where the force is a defendant as a unit, it needs good representation. They need a skillful advocate. This is because if implicated in an offense, this would greatly hurt the public image. This could be very damaging because they operate based on the trust of other citizens. Where an army acquires a bad reputation, it becomes very hard to turn it around.

When it so happens that a citizen sues the army as a unit, it needs to be represented in court. They may engage outside advocates, but only in conjunction with their own. Those in their employ know the law under which they operate through and through.

Like any other practitioner, these advocates need to have their credentials in order. They must have gone through all courses required to qualify them as lawyers. They must have their practicing certificates all the time, and they should be current. Lack of this invalidates any action taken in their capacity as lawyers. It may even lead to losing a case because they would be operating illegally.

Military attorneys must have sharp legal minds because they are involved in a technical area of law. They must comply with any other rules that they are under due to the nature of their job. Could be provisions as to rank and discipline. However, on the basis of it, they do what other advocates do. The difference is that theirs is in a controlled environment with its own rules and regulations.
