A Summary Of The Various Grounds For Divorce

By Alaric Sowerby

If ever you wish to divorce your partner, you need to have a really good reason. The court will never terminate your marriage just because you said you do not like to be wedded to your spouse for no reason whatsoever. The dissolution of marriage will be decided by the judge based on the reasons issued by the petitioner. So now, let's focus on the grounds for divorce.

Cheating is a powerful ground for divorce but one needs to prove that the other party performed adultery in front of the court. It is easier if the offending party admits they did have affairs with another person. Even so, the evidence that the other party is having sexual affairs with another person may be difficult to obtain. On the contrary, infidelity may not be applied as a ground if it turns out your partner engages in homosexual relationships while you are still together. In this situation, a different ground for divorce may be used.

Unreasonable behavior is another ground which could be used to sustain a divorce case. In cases where it's impossible to live with your spouse due to their inappropriate behavior, you may file for a quick divorce. Keep yourself impartial when summarizing your disappointment mainly because if you're way too emotional, that could get in the way of smooth negotiations sooner or later. The court could assess the extent of the unreasonable behavior of the offending partner. You need to be ready to establish a compelling reason why your partner's behavior has created animosity in your relationship.

Desertion is another ground for divorce. If your spouse has left you for over two years without any good reason and without your consent, that is desertion. And you may choose to quit your marriage in their absence.

A related scenario is separation and there happen to be 2 kinds of separation with the divorce law. Two(2) years of separation suggests that you and your spouse have lived in different houses for over two years. This is a good ground for divorce, particularly when both of you really want a quick divorce. The other word for this is known as no-fault divorce.

Another type of separation will be one that occurs for over five years and therefore it's called 5 year separation. The other may not consent a divorce yet it's not anymore necessary. When you file for divorce, the other can will no longer defend the petition.

In many cases, the first two reasons are used by petitioners since you don't need to wait around for years of separation in order to file for a petition. Divorce process may be made faster if you and your spouse agree to the ending of your marriage bond. Even when you apply adultery or hostile behavior of the other as grounds, it will always be an edge if both of you are in agreement that your marriage has deteriorated beyond repair.
